At Fault Driver

Compensation from the At-Fault Driver.  You may have a right to claim compensation from the driver who caused the accident if you have suffered a permanent serious disfigurement or a permanent serious impairment of an important physical, mental or psychological function. If your injuries meet the threshold you may have a right to claim compensation from the at-fault driver, for:

  • Pain and Suffering;
  • Loss of Enjoyment of Life; and,
  • Loss of Amenities.

Your claim for pain and suffering and other non-pecuniary damages is subject to a $36,905.40 monetary deductible in 2016, which increases in each subsequent year by the consumer price index, unless your claim is valued in excess of $123,016.99, which will also be indexed.

You may also have the right to claim compensation for:

  • Past and Future Loss of Income;
  • Other Expenses you have incurred as a result of the accident; and,
  • Other Family Member’s Claims’ for expenses and compensation for the loss of care, guidance and companionship they have suffered by reason of your injuries.

Accidental Evidence

Statutory Accident Benefits On Or after June 1st. 2016.  A person can sustain light musculature injuries, such as bruises and scratches, that if not properly treated  may develop into a chronic pain disorder; and more serious injuries, such as head injury, neck, spine, back and chest injuries, etc. as a result of a Car Accident. The person can also sustain a psychological disorder such as depression, anxiety, sleep disorders and a specific phobia such as driving or being a passenger. The consequences resulting from an accident might appear after days, weeks, or even months after the accident occurred.

Only an experienced Personal Injury Specialist will be able to assess your claim properly and to achieve the maximum possible compensation in any individual case.  As an insured, you are entitled to seek benefits from your own insurer.

Minor Injury

If your injuries are considered minor in nature, as defined by the Statutory Accident Benefits Schedule, there is maximum benefit of $3,500 for medical and rehabilitation expenses. Once you have exhausted this amount, our firm will assess your situation to determine if further treatments or medical assessments is required to reach pre accident functional ability. 

Attendant Care Benefits

You may make a claim for expenses to pay for the cost of providing an aide to pay all reasonable expenses to care for you. For a Non-catastrophic the benefit allowed is a maximum of $3,000.00 per month up to 5 years. Case of a Catastrophic Impairment, as defined by the SABS, there is a maximum monthly Attendant Care benefit of $6,000.00, with a combined lifetime limit of $1,000,000.00 for Attendant Care and Medical and Rehabilitation Expenses.

Medical and Rehabilitation Expenses

If your injuries cannot be managed under the injury guideline, you have access to $65,000 in medical and rehabilitation benefits.

Housekeeping and Home Maintenance

There is no housekeeping and home maintenance for minor injuries and non-catastrophic injuries. If your injuries are catastrophic the benefit payable if $100.00 per week.

Income Replacement

Income replacement benefits pay 70% of your gross income up to $400.00 per week.

Non Earners

Non-earner Benefits is payable in the amount of $185 per week, which is not payable for the first four weeks after the accident and is payable for up to two years.

Caregiving Benefits

Caregiving Benefits available is $250 per week for the first person in need of care plus $50 per week for each additional person in the case of a catastrophic impairment

Slip & Fall
